Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using HMPos, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use HMPos.

2. Service Description

HMPos is a cloud-based POS system designed specifically for laundry and dry cleaning businesses in the United Kingdom. The service includes:

• Order management and tracking
• Customer management and CRM
• Inventory and stock management
• Billing and invoicing
• Delivery tracking
• Reporting and analytics
• Hardware integration (POS terminals, printers, barcode scanners)

3. User Accounts

To use HMPos, you must:

• Be at least 18 years of age
• Provide accurate, complete, and current information
• Maintain the security of your account credentials
• Be responsible for all activities under your account
• Notify us immediately of any unauthorised access

4. Subscription and Payment

HMPos is offered on a subscription basis with the following terms:

• Subscription fees are charged monthly or annually as selected
• Prices are subject to change with 30 days notice
• Free hardware is included with eligible plans (terms apply)
• Payment is due on the billing date
• Failure to pay may result in service suspension
• Cancellations must be made at least 30 days before renewal

5. Hardware Provision

HMPos provides hardware (POS terminal, printer, barcode scanner) as part of eligible subscription plans:

• Hardware remains the property of HMPos Limited
• Hardware must be returned upon subscription termination
• Users are responsible for hardware damage beyond normal wear
• Hardware warranty covers manufacturing defects for 12 months
• Replacement hardware may incur additional charges

6. Acceptable Use

You agree not to:

• Use HMPos for any unlawful purpose
• Attempt to gain unauthorised access to HMPos systems
• Interfere with or disrupt HMPos service
• Use HMPos to store or process illegal content
• Share your account credentials with others
• Reverse engineer or attempt to extract source code

7. Data and Privacy

Your use of HMPos is subject to our Privacy Policy. Key points:

• We collect and process data as described in our Privacy Policy
• You retain ownership of your business data
• We use industry-standard security measures
• Data is stored in UK-based data centres
• We comply with GDPR and UK data protection laws

8. Intellectual Property

HMPos and all related software, designs, logos, and content are owned by HMPos Limited and protected by copyright and other intellectual property laws. You do not acquire any ownership rights in HMPos software.

9. Service Availability

HMPos is provided "as is" and may be subject to:

• Scheduled maintenance downtime (with notice)
• Unscheduled interruptions for technical issues
• Feature updates and modifications
• We aim for 99.5% uptime but do not guarantee uninterrupted service

10. Limitation of Liability

To the maximum extent permitted by law:

• HMPos is provided on an "as is" and "as available" basis
• We exclude all implied warranties to the fullest extent permitted
• We are not liable for indirect, incidental, or consequential losses
• Our total liability is limited to fees paid in the preceding 12 months
• Nothing excludes liability for death or personal injury caused by negligence

11. Termination

We may suspend or terminate your account if:

• You breach these Terms
• Payment is not received
• We are required to do so by law
• We cease to offer HMPos or relevant features

You may terminate your account at any time by providing 30 days notice. Upon termination, you must return all hardware and your data will be deleted according to our data retention policy.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via email or in-app notification. Your continued use of HMPos after changes take effect constitutes acceptance of the updated Terms.
